Terms of Service

These Terms of Service ("Terms") govern your use of the Rackd application and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old to use Rackd. If you are between 13 and the age of legal majority where you live, you must have a parent or legal guardian's permission. By using the Service, you represent that you meet these requirements.

2. Your Account

You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us at support@rackdlife.com if you suspect unauthorized access. You may not let someone else use your account, and you may not share, sell, or transfer it.

3. Health and Fitness Disclaimer

Important

Rackd is not a substitute for professional medical advice, diagnosis, or treatment. The workouts, exercises, and information provided by Rackd are for general fitness and informational purposes only.

Consult a qualified healthcare provider before starting any exercise program, especially if you are pregnant, have a medical condition, are recovering from injury, take medication, or have not exercised regularly. Stop exercising and seek medical attention immediately if you experience pain, dizziness, shortness of breath, or any other warning sign.

You exercise at your own risk. By using Rackd, you assume full responsibility for any injury, illness, or other consequence that may result from your exercise activity.

4. Your Content

You may create custom workouts, fork existing workouts, and add details to your profile. We call all of this "Your Content." You retain ownership of Your Content. By submitting Your Content to the Service, you grant Rackd a worldwide, non-exclusive, royalty-free license to host, store, display, and back up Your Content for the purpose of operating the Service. This license ends when you delete Your Content or your account, except for content you've shared publicly or with friends, which they may have already saved or copied.

You are responsible for Your Content. Don't submit anything you don't have the right to share.

6. Intellectual Property

The Service — including its design, branding, logos, code, and original content — is owned by Rackd or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service in accordance with these Terms. We do not grant you any other rights.

7. Subscriptions and Payments

Some features of Rackd may be offered as paid subscriptions in the future. If you purchase a subscription, billing is handled by Apple (App Store) or Google (Play Store) under their terms. We use RevenueCat to manage subscription state. Subscription terms, including auto-renewal, refunds, and cancellation, follow the rules of the platform you purchased from. You can manage and cancel subscriptions in your App Store or Play Store account settings.

8. Service Availability and Changes

We may update, modify, or discontinue parts of the Service at any time. We don't guarantee uninterrupted availability, and we may take the Service offline for maintenance, security, or other operational reasons. We are not liable for any inability to access the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Rackd disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any specific outcome — fitness improvement, weight change, performance gain — will result from your use of the Service.

10. Limitation of Liability

To the fullest extent permitted by law, Rackd will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or personal injury — arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

If you suffer a loss for which Rackd is found liable despite the limitations above, our total cumulative liability to you will not exceed the greater of (a) the amount you paid Rackd in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Rackd and its team from any claim, demand, loss, damage, or expense (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access — with or without notice — if you violate these Terms, if we believe your activity poses a risk to Rackd or other users, or if we discontinue the Service. Provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will continue to apply.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Maury County, Tennessee, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll notify you in the app, by email, or by posting a prominent notice on rackdlife.com. Your continued use of the Service after the change takes effect means you accept the updated Terms.
